When the Bank Account Does Not Allow New Purchases, Buyers Become Creative

In the age of smartphones, tablets and notebooks, technological development is advancing ever more rapidly. The smartphone one purchased a month ago is already technically outdated within half a year. And who wants to deal with “obsolete” technology or even be looked at sideways by friends because of it? This pressure of having the latest “must-have” item affects not only teenagers but also adults, who sometimes resort to curious ideas in order to obtain a newer model at low cost.

New Television? Let the Insurance Pay!

An example that, in this or a similar form, has increasingly troubled insurers in recent years: Max and his friends Egon and Heinz may not be outright technology enthusiasts, but a certain status symbol is appreciated. And the electronics industry constantly offers updates and upgrades – for example, a newer, larger, more stylish television set, naturally UHD and 3D capable. Egon and Heinz already have one; only Max has so far had to hold back when looking at his bank account. As a result, matches of their favourite football club are now watched only at Egon’s or Heinz’s place, because Max’s television is considered “outdated”.

Max therefore devises a plan: the living room is rearranged at short notice, and the television is placed directly next to the window. Max opens the window, checks the distance and height – perfect. Then, with considerable force and momentum, he slams the window casement against the television, which gives way under the impact and falls from the TV stand onto the cast-iron dumbbells stored beside it. The entire frame shatters, and the delicate technology inside the device is destroyed. Max immediately informs his household contents insurer that a “sudden gust of wind” had forced the window open, causing significant damage to the television. It is beyond repair, and he requests compensation for the loss.

In the scenario described above, Max is not committing a minor indiscretion but a criminal offence punishable as insurance abuse pursuant to § 265 of the German Penal Code.
